The Coolbaugh Township Planning Commission Meeting of August 8, 2005 was held in the Township Municipal Center, in Building #3, at 5550 Memorial Boulevard, Tobyhanna, Pennsylvania.

 

 

Call To Order

 

Mr. Frank called the meeting to order at approximately 7:00 p.m. and led those in attendance in the recitation of the Pledge of Allegiance to the Flag.

 

Members present included: Mr. Werner Frank, Mr. Wayne Horne, Mr. Ronald Kluge, Mr. Bernard Kozen and Ms. Alma I. Ruiz-Smith. Also present were PC Engineer Russ Kresge and Recording Secretary Jeri Inness. PC Solicitor Clark Connor was absent.

 

 

Approval of July 11, 2005 Meeting Minutes

 

Motion: Mr. Kluge moved to approve the July 11, 2005 Meeting Minutes and dispense with the reading. Seconded by Ms. Ruiz-Smith. Discussion - none. The motion carried

5-0.

 

 

Lowe’s Home Centers, Inc./ Pocono Star Properties, Inc. - Minor Subdivision Plan

 

No one was present on behalf of the above referenced Minor Subdivision Plan. Township Engineer Russ Kresge commented that there was nothing new on this plan as of tonight’s meeting. Mr. Frank noted that the review time for the project runs out on September 9, 2005, which is prior to the next PC meeting on September 12th, so another request for an extension is necessary. Jake Seip of Pocono Star Properties, Inc. stood up and asked if the Planning Commission would agree to move to the next agenda items, in case a representative of the project was running late. No objection was heard.

 

 

Mr. Frank announced that the Planning Commission would continue on to Item #4 on the Agenda, the Scavello Route 940 project.

 

 

Scavello - Route 940 Minor Subdivision / Lot Combination / Preliminary / Final Land Development Plan

 

Lou Cozza of Niclaus Engineering was present on behalf of the above referenced plan.

Mr. Cozza proceeded to go through comments in a letter from Township Engineer Russ Kresge dated August 4, 2005. Discussion followed regarding whether the Township should be provided with copies of future correspondence from PA DEP, indicating whether or not a public water system permit is required. Mr. Kresge and  Mr. Cozza determined that this issue could be part of the development agreement. Also discussed were the matters of PA DEP approval of the Planning Module, approval of the erosion and sediment pollution control plan by the MCCD and receipt of the NPDES permit, the development agreement, stormwater management, PennDOT highway occupancy permit and access issues, requests for waivers, etc. Further discussion ensued about parking, parking lot islands, lighting, buffers, the Township Zoning Officer’s memo dated August 2, 2005, and that there did not appear to be problems with this project in the local community. Mr. Frank noted that there were four (4) requests for relief that needed to be addressed. Public comment was heard from Steve Planchock.

 

Motion: Mr. Kluge moved to recommend to the Board of Supervisors that they grant the applicants’ request for a modification of Ordinance #65B - Stormwater Management Ordinance, Appendix E, §2.3.A (3). Seconded by Ms. Ruiz-Smith. Discussion - none. The motion carried 5-0.

 

Motion: Mr. Kluge moved to recommend to the Board of Supervisors that they grant the applicants’ request for a modification of Ordinance #65B - Stormwater Management Ordinance, Appendix E, §2.3.A (6). Seconded by Ms. Ruiz-Smith. A brief discussion followed about PA DEP regulations and where stormwater flowing from the site would go. Public comment was heard from Steve Planchock. The motion carried 5-0.

 

Motion: Mr. Kluge moved to recommend to the Board of Supervisors that they grant the applicants’ request for a modification of Ordinance #65B - Stormwater Management Ordinance, Appendix E, §2.3.B (1). Seconded by Ms. Ruiz-Smith. Discussion - none. The motion carried 5-0.

 

A brief discussion followed about the applicants’ request for relief from §404.11.T.6 of the Subdivision and Land Development Ordinance. Mr. Cozza noted that this waiver may or may not be needed, pending PennDOT’s approval of a proposed access plan. However, he wanted to take a recommendation for relief to the Board of Supervisors, if the Planning Commission also recommended that the Board approve the Land Development Plan. Public comment was heard from Steve Planchock.

 

Motion: Mr. Kozen moved to recommend to the Board of Supervisors that they grant the applicants’ request for a modification of §404.11.T.6. of the Subdivision and Land Development Ordinance. Seconded by Mr. Kluge. Discussion - none. The motion carried 5-0.

Motion: Mr. Kozen moved to recommend to the Board of Supervisors that they approve the Scavello - Route 940 Minor Subdivision / Lot Combination / Preliminary / Final Land Development Plan with the following conditions: 1) the Township should be provided with copies of future correspondence from the PA DEP indicating whether or not a public water system permit is required; 2) approval of the Planning Module by the PA DEP; 3) approval of the erosion and sediment pollution control plan by the MCCD and receipt of the NPDES permit; 4) the applicants provide the required easement for the detention basin outlet line and potential discharge from the emergency spillway across the adjacent property; 5) PennDOT approval is received for the proposed detention basin discharge into the right-of-way of SR 940; 6) the proposed detention basin discharge structure is within SR 940, in front of the adjacent property, and written permission is provided for this arrangement; 7) a PennDOT highway occupancy permit and specific authorization of the Board of Supervisors is provided for the proposed access to SR 940 and a township driveway permit is obtained for the proposed access to Summit Avenue; 8) the Township Solicitor reviews the proposed stormwater maintenance agreement 9) requests for modifications are granted. The motion was seconded by Mr. Horne. Discussion - none. The motion carried 5-0.

 

 

Preliminary Site Plan, Hemlock Estates, Arcadia Homes of Lehigh Valley, LLC

 

No one was present on behalf of the Preliminary Site Plan, Hemlock Estates, Arcadia Homes of Lehigh Valley, LLC . Mr. Frank noted that this project received an extension until October 18, 2005.

 

Motion: Mr. Kozen made a motion to table the Preliminary Site Plan, Hemlock Estates, Arcadia Homes of Lehigh Valley, LLC. Seconded by Ms. Ruiz-Smith. Discussion - none. The motion carried 5-0.

 

 

Pocono Mountains Industries Minor Subdivision Plan

 

No one was present on behalf of the Pocono Mountains Industries Minor Subdivision Plan. Mr. Frank noted that this project had an extension until September 20, 2005.

 

Motion: Mr. Horne moved to table the Pocono Mountains Industries Minor Subdivision Plan. Seconded by Mr. Frank. Discussion followed in which Lou Cozza of Niclaus Engineering, (the engineering firm handling the PMI Minor Subdivision Plan), commented that the Board of Supervisors wants to leave this matter on the agenda until any outstanding issues are resolved. The motion passed 5-0.

With all other agenda items addressed, Mr. Frank returned to Lowe’s Home Center, Inc. for discussion.

 

 

Lowe’s Home Centers, Inc./ Pocono Star Properties, Inc. - Minor Subdivision Plan

Lowe’s Home Centers, Inc. - Preliminary Land Development Plan

 

No additional representatives for the above referenced project were present at this point in the meeting. Jake Seip of Pocono Star Properties, Inc. said the applicants will get a letter to the Township by tomorrow, August 9, 2005, requesting a time extension on the Lowe’s plans until October 18, 2005.

 

Motion: Mr. Kozen moved to table discussion of the Lowe’s Home Centers, Inc./ Pocono Star Properties, Inc. - Minor Subdivision Plan and Lowe’s Home Centers, Inc. - Preliminary Land Development Plan. Seconded by Mr. Horne. Discussion - none. The motion carried 5-0.

 

Motion: Mr. Kozen made a motion to recommend to the Board of Supervisors that they grant the applicants’ request for an extension until October 18, 2005 on the Lowe’s Home Centers, Inc./ Pocono Star Properties, Inc. - Minor Subdivision Plan and the

Lowe’s Home Centers, Inc. - Preliminary Land Development Plan. Seconded by Ms. Ruiz-Smith. Discussion - none. The motion carried 5-0.

 

 

Public Input - none.

 

 

Adjournment

 

Motion: With no further business before the Commission, Ms. Ruiz-Smith made a motion to adjourn the meeting. Seconded by Mr. Kluge. The motion carried 5-0.
